Privacy Policy

Broadway Services, Inc. (the “Company”) respects the privacy of all visitors to www.broadwayservices.com and www.broadwaytransport.com (collectively, the “Site”).  Except as otherwise provided in this Privacy Policy, the information collected through the Site is not shared with third parties.

How Information Is Collected About You

The Site’s web server automatically recognizes the IP address of each visitor, but it does not gather information about the visitor’s domain or e-mail address. As you use the Site, passive tracking mechanisms in the form of “cookies” collect information about your use of the Site.  One type of cookie, a “session cookie,” remains active only for as long as the Site is being used during a given session.  These cookies are accessible by the Company and its authorized agents.  A visitor may block or disable one or more cookies during a given session, but certain webpages of the Site may not fully function as a result.

Personal information is collected from a visitor only if the visitor elects to submit an employment application through www.broadwayservices.com (the “Employment Application”), or if the visitor requests a quote through www.broadwayservices.com (“Quote Request”), or if the visitor places an online order through www.broadwaytransport.com (the “Order Form”).  The personal information collected as part of the Employment Application includes, but is not limited to, the visitor’s name, address, phone number, social security number, date of birth, education, and employment history.  The personal information collected as part of the Quote Request includes, but is not limited to, the visitor’s name, phone number, billing address, delivery address and e-mail address.  The personal information collected as part of the Order Form includes, but is not limited to, the visitor’s name, billing and delivery addresses, and phone number.

Why Information Is Collected and How It Is Used

Cookies can contain pieces of information that make the Site easier or more enjoyable to use.  The information collected permits the Company to maintain communications with the visitor.  From time to time, the Company may implement new uses.  The Employment Application and the Order Form serve the employment and order processing needs of the Company.  The Company will inform visitors of such new uses in advance by posting an updated Privacy Policy to the Site.  All visitors should check the Site periodically for updates.

When Information is Shared with Others

Except as incidental to the administration, maintenance, development, support, or security of the Site, the Company’s procedures with respect to hiring personnel, the Company’s procedures with respect to order processing, or as otherwise set forth in this Privacy Policy, the Company does not share the information collected from visitors with third parties.  The Company will disclose visitor information to comply with applicable law, regulation, or legal proceeding, or to defend itself against any claims from a visitor or third party.

How the Company Protects Information

The Company uses commercially reasonable efforts to protect all information collected through the Site. For purposes of protecting the personal information collected as part of the Employment Application or the Order Form, the visitor is directed to a secure https protocol that performs bidirectional encryption.

California Privacy Rights

The “Shine the Light” law enacted by the State of California in 2005 allows California residents to obtain a list of third parties to whom a business has disclosed personal information if it shares such information with third parties for their direct marketing purposes.  However, if a business adopts and discloses in its privacy policy a policy of not disclosing customers’ personal information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, the business may comply with the law by notifying the customer of his or her right to prevent disclosure of personal information and by providing a cost-free means to exercise that right.  The Company does not collect or use any personal information obtained through the Site for marketing and promotional purposes.

Changes to this Policy

The Company may change this Privacy Policy in whole or in part from time to time.  Any changes to this Privacy Policy will be posted to the Site with an appropriate effective date.  All visitors should check the Site periodically for changes to this Privacy Policy.
